1. General Overview

These Terms and Conditions (“Terms”) govern your use of the Alberta Caregivers & Support Services (ACSS) website, online portal, and related services. By signing up as a Client/Family or as a Caregiver, you agree to these Terms and to abide by ACSS policies, standards, and applicable Alberta and Canadian laws.

“ACSS”, “we”, “our”, or “us” refers to Alberta Caregivers & Support Services, a registered care support agency based in Calgary, Alberta, Canada.
“You” refers to the user — whether a client, family representative, or caregiver/support practitioner.

2. Use of the Website and Portal

  • You must be at least 18 years old to create an account.
  • You agree to provide accurate, complete, and current information when signing up.
  • You are responsible for maintaining confidentiality of your account login credentials.
  • You may not use the ACSS platform for any unlawful or unauthorized purpose.

3. Terms for Families and Clients Requesting Care

3.1 Registration and Matching

When you sign up as a client or family, you agree to provide truthful information about:

  • The person receiving care
  • Their care needs, medical or mobility status (if applicable)
  • Location and scheduling preferences

This information helps ACSS assign or recommend a suitable caregiver.

3.2 Service Requests

  • ACSS may contact you by phone or email to confirm details.
  • Provide caregiver options and rates.
  • Arrange an initial visit (virtual or in-person).

Service is not confirmed until the ACSS Care Agreement and Care Plan are approved and scheduled.

3.3 Payment and Billing

  • All services are billed according to the rate card at booking time.
  • Payment is required through approved ACSS channels only.
  • Late payments may result in suspension of service.
  • Funded clients must ensure paperwork is approved before care starts.

3.4 Cancellations and Rescheduling

  • 24 hours’ notice is required for cancellations.
  • Short-notice cancellations may incur a minimum charge.
  • ACSS may replace or reschedule caregivers if necessary.

4. Terms for Caregivers and Support Practitioners

4.1 Registration and Eligibility

  • You must be legally eligible to work in Canada.
  • Valid ID and CPR/First Aid certification required.
  • Provide documentation of qualifications and background checks.

4.2 Background and Reference Checks

  • Annual vulnerable sector and criminal checks required.
  • Two verifiable professional references required.
  • Maintain current certifications.

4.3 Work Status

  • Independent Contractors handle their own taxes, insurance, and scheduling.
  • Employees follow ACSS payroll and policies.

4.4 Assignments and Professional Conduct

  • Follow care plans and Behavior Support Plans (BSPs).
  • Arrive punctually and maintain professionalism.
  • Use the portal for documentation.
  • Respect client privacy and property.
  • No personal or financial relationships with clients.

4.5 Non-Solicitation

  • No direct employment from ACSS clients.
  • No private arrangements outside ACSS.

4.6 Documentation and Reporting

  • Daily care notes
  • Incident reports
  • Medication logs (if certified)
  • Change-in-condition forms

4.7 Safety and Emergency Response

  • Use protective equipment.
  • Report falls and accidents immediately.
  • Follow infection control and safe transfer rules.

4.8 Payment Terms

  • Contractors paid based on approved hours.
  • Employees paid via payroll.
  • Missing documentation may delay payment.
  • Unauthorized overtime will not be paid.

5. Confidentiality and Privacy

Both clients and caregivers must protect personal health information (PHI) and internal ACSS data. All data is stored securely following PIPA/PIPEDA standards.

6. Termination of Account or Services

  • False information
  • Policy violations
  • Abuse or harassment
  • Unpaid obligations

Users may request deactivation anytime by emailing support@albertacaregivers.ca.

7. Liability Disclaimer

ACSS is not liable for damages beyond Alberta law. Clients must maintain a safe environment, and caregivers must follow protocols.

8. Amendments and Updates

ACSS may update these Terms periodically. Continued platform use implies acceptance of updates.

All client information is protected under PIPEDA and Alberta’s PIPA. Caregivers are bound by confidentiality agreements.

All data is stored securely. You consent to ACSS using this information for service coordination, safety, and compliance.

4. Termination of Account or Services

  • Providing false information
  • Violating policies or safety standards
  • Abuse or harassment

Users may deactivate accounts anytime by emailing support@albertacaregivers.ca.

5. Liability Disclaimer

ACSS carefully selects and trains caregivers, but services are provided “as available.” ACSS is not liable for damages beyond what Alberta law permits. Clients must maintain safe environments; caregivers must follow ACSS protocols.

6. Amendments and Updates

Terms may be updated periodically. Updated versions will be posted online. Continued use constitutes acceptance of the updated Terms.
